Man charged with sexual assault
A 32-year-old Brooklyn Park Man faces felony criminal sexual conduct charges after he reportedly had sex with an acquaintance while she slept at a Farmington home.
Thoeun Nay was reportedly staying with a number of other people at a Farmington home last November when the incident occurred. Another individual who was staying at the house told police he woke in the middle of the night to find Nay, who he knew only as "B-Dog," having sex with the woman as she slept next to him on the living room floor. Both the witness and the victim knew Nay only through the victim's sister, who owned the house where everyone was staying.
The witness told police Nay claimed the woman had propositioned him, but according to a complaint filed last week in the Dakota County Attorney's office the woman was asleep and snoring at the time. When the witness confronted him, Nay reportedly ran from the house.
On Nov. 4, the victim shared with police a voicemail message from Nay in which he said he said he thought she was a willing participant because she hadn't refused him.
If convicted on a third degree criminal sexual conduct charge Nay could face up to 15 years in jail and fines of up to $30,000.
