ORDINANCE NO. 008-594

AN ORDINANCE AMENDING TITLE 11 OF THE FARMINGTON CITY CODE, THE SUBDIVISION ORDINANCE, CONCERNING STORM DRAINAGE

NOTICE IS HEREBY GIVEN that, on December 1, 2008, Ordinance No. 008-594 was adopted by the City Council of the City of Farmington, Minnesota.

NOTICE IS FURTHER GIVEN that, because of the lengthy nature of Ordinance No. 008-594, the following summary of the ordinance has been prepared for publication.

NOTICE IS FURTHER GIVEN that Section 11-4-7 has been amended to include standards governing post construction water quality criteria, runoff temperature control criteria, peak runoff rate control criteria, and drainage alteration for storm drainage. The ordinance requires that post construction stormwater runoff quality measures comply with the General Permit Authorization to Discharge Stormwater Associated with Construction Activity Under the National Pollutant Discharge Elimination System/State Disposal System Permit Program Permit MN R100001 (NPDES General Construction Permit) issued by the Minnesota Pollution Control Agency on August 1, 2003, but prefers other measures in areas that drain to or are in areas tributary to the trout stream portions of the Vermillion River (trout stream). The ordinance requires that specific measures be taken to control water temperature increases in the trout stream, the water runoff rate be analyzed, and certain types of developments incorporate water runoff volume control practices. The ordinance permits certain drainage outlets and artificial drainage diversions with the conditions specified in the ordinance.

A printed copy of the whole ordinance is available for inspection by any person during the City’s regular office hours.
