ORDINANCE NO. Ord 012-648

AN ORDINANCE AMENDING TITLE 3, CHAPTER 12 OF THE FARMINGTON CITY CODE RELATING TO LIQUOR SALES, MODIFYING REQUIREMENTS THAT AUTHORIZE ON-SALE WINE LICENSEES TO SELL INTOXICATING MALT LIQUORS WITHOUT ADDITIONAL LICENSE

THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:

SECTION 1. Title 3, Chapter 12, Section 4 (E) of the Farmington City Code is hereby amended by deleting the strikethrough language and adding the underlined language as follows:

(E) "Wine License": Wine licenses shall be granted only to restaurants for the sale of wine not exceeding fourteen percent (14%) alcohol by volume, for consumption on the premises only, in conjunction with the sale of food.

A holder of an on-sale wine license who is also licensed to sell 3.2 percent malt liquors at on-sale pursuant to MSA section 340A.411, and whose gross receipts are at least sixty percent (60%) attributable to the sale of food, is authorized to sell intoxicating malt liquors at on-sale without an additional license.

SECTION 2.This ordinance shall be effective immediately upon its passage.

ADOPTED this 15th day of October, 2012, by the City Council of the City of Farmington, Minnesota.
