A 43-year-old Zumbro Falls man faces DWI charges after he reportedly nearly swerved into another car on Highway 52 in Hampton Township.
Another driver called police shortly after 11 a.m. Oct. 19, 2011, to report the incident. The driver told dispatchers the other car was “swerving all over the road” as he drove south.
According to a complaint filed in the Dakota County Attorney’s office, the deputy located the vehicle and saw it straddling the fog line and weaving between lanes. The car nearly hit a guard rail before the deputy made a traffic stop.
The driver of the vehicle was Thomas Christopher Tiede. He said he hadn’t been drinking, but according to the complaint Tiede’s speech was slurred. A preliminary breath test indicated a blood alcohol content above the legal limit for driving and a more conclusive test given at the Dakota County Sheriff’s office indicated a BAC of .12.
Tiede has two prior DWI convictions.
If convicted on either of two gross misdemeanor DWI charges Tiede could face up to a year in jail and fines of up to $3,000.
